How do we collect your data?
On the one hand, your data is collected when you provide it to us. This can be, for example, data that you enter in a contact form.
Other data is collected automatically or after your consent when you visit the website, by our IT systems. This is mainly technical data (e.g. internet browser, operating system or time of the page view). This data is collected automatically as soon as you enter this website.
What do we use your data for?
Some of the data is collected to ensure error-free provision of the website. Other data may be used to analyse your user behaviour.
What rights do you have regarding your data?
You have the right at any time to receive information free of charge about the origin, recipient and purpose of your stored personal data. You also have the right to request the correction or deletion of this data. If you have given your consent to data processing, you can revoke this consent at any time with effect for the future. You also have the right to request the restriction of the processing of your personal data under certain circumstances. Furthermore, you have the right to lodge a complaint with the competent supervisory authority.
You can contact us at any time regarding this and any further questions on the subject of data protection.
Third-party analytics and tools
When you visit this website, your browsing behaviour may be evaluated statistically. This is done primarily with so-called analysis programs. Detailed information about these analysis programs can be found in the following privacy policy.
2. Hosting
We host the content of our website with the following provider:
Hetzner
The provider is Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany (hereinafter Hetzner). The servers are located in Germany.
For details, please refer to Hetzner’s privacy policy: https://www.hetzner.com/de/rechtliches/datenschutz.
The use of Hetzner is based on Art. 6(1)(f) GDPR. We have a legitimate interest in the most reliable presentation of our website possible. Insofar as corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and Section 25(1) TDDDG, insofar as the consent covers the storage of cookies or access to information on the user’s terminal device (e.g. device fingerprinting) within the meaning of the TDDDG. Consent can be withdrawn at any time.
Data processing agreement
We have concluded a data processing agreement (DPA) for the use of the above-mentioned service. This is a contract required by data protection law, which ensures that the provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.
3. General notes and mandatory information
Data protection
The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this privacy policy.
When you use this website, various personal data is collected. Personal data is data by which you can be personally identified. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this is done.
We would like to point out that data transmission on the internet (e.g. when communicating by email) can have security gaps. Complete protection of data against access by third parties is not possible.
Information about the responsible party
The party responsible for data processing on this website is:
MucDigital GmbH
Fabian Engel
Oskar-von-Miller-Ring 31
80333 München, Germany
Phone: +49 (0)89 2306 9793
E-Mail: kontakt@website-helden.com
The responsible party is the natural or legal person who alone or jointly with others determines the purposes and means of the processing of personal data (e.g. names, email addresses or similar).
Storage period
Unless a more specific storage period is stated within this privacy policy, your personal data will remain with us until the purpose for processing the data no longer applies. If you assert a legitimate request for deletion or revoke your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g. retention periods under tax or commercial law); in the latter case, the data will be deleted once these reasons no longer apply.
General information on the legal basis for data processing on this website
If you have consented to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR if special categories of data are processed in accordance with Art. 9(1) GDPR. In the case of explicit consent to the transfer of personal data to third countries, data processing is also based on Art. 49(1)(a) GDPR. If you have consented to the storage of cookies or to access to information on your terminal device (e.g. via device fingerprinting), the data processing is additionally carried out on the basis of Section 25(1) TDDDG. Consent can be withdrawn at any time. If your data is required for the performance of a contract or for the implementation of pre-contractual measures, we process your data on the basis of Art. 6(1)(b) GDPR. Furthermore, if your data is required for the fulfilment of a legal obligation, we process it on the basis of Art. 6(1)(c) GDPR. Data processing may also be carried out on the basis of our legitimate interest in accordance with Art. 6(1)(f) GDPR. Information on the relevant legal basis in each individual case is provided in the following paragraphs of this privacy policy.
Note on data transfer to the USA and other third countries
Among other things, we use tools from companies based in the USA or in other third countries that are not secure under data protection law. If these tools are active, your personal data may be transferred to these third countries and processed there. We would like to point out that no level of data protection comparable to that in the EU can be guaranteed in these countries. For example, US companies are obliged to hand over personal data to security authorities without you as a data subject being able to take legal action against this. It can therefore not be ruled out that US authorities (e.g. intelligence services) process, evaluate and permanently store your data located on US servers for monitoring purposes. We have no influence on these processing activities.
Withdrawal of your consent to data processing
Many data processing operations are only possible with your express consent. You can withdraw consent you have already given at any time. The lawfulness of the data processing carried out up to the point of withdrawal remains unaffected by the withdrawal.
Right to object to data collection in special cases and to direct advertising (Art. 21 GDPR)
IF THE DATA PROCESSING IS CARRIED OUT ON THE BASIS OF ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA AT ANY TIME FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA CONCERNED UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING SERVES THE PURPOSE OF ASSERTING, EXERCISING OR DEFENDING LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21(1) GDPR).
IF YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT ADVERTISING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH ADVERTISING; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS RELATED TO SUCH DIRECT ADVERTISING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT ADVERTISING (OBJECTION PURSUANT TO ART. 21(2) GDPR).
Right to lodge a complaint with the competent supervisory authority
In the event of violations of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the member state of their habitual residence, their place of work or the place of the alleged violation. This right to lodge a complaint is without prejudice to other administrative or judicial remedies.
Right to data portability
You have the right to have data that we process automatically on the basis of your consent or in fulfilment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done insofar as it is technically feasible.
Information, correction and deletion
Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of data processing and, if necessary, a right to correction or deletion of this data. You can contact us at any time regarding this and any further questions on the subject of personal data.
Right to restriction of processing
You have the right to request the restriction of the processing of your personal data. You can contact us at any time for this purpose. The right to restriction of processing exists in the following cases:
- If you dispute the accuracy of the personal data we hold about you, we usually need time to verify this. For the duration of the review, you have the right to request the restriction of the processing of your personal data.
- If the processing of your personal data happened or is happening unlawfully, you can request the restriction of data processing instead of deletion.
- If we no longer need your personal data, but you need it to exercise, defend or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of its deletion.
- If you have lodged an objection pursuant to Art. 21(1) GDPR, a balancing of your interests and ours must be carried out. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.
If you have restricted the processing of your personal data, this data may – apart from being stored – only be processed with your consent or for the assertion, exercise or defence of legal claims, or for the protection of the rights of another natural or legal person, or for reasons of important public interest of the European Union or a member state.
SSL / TLS encryption
For security reasons and to protect the transmission of confidential content, such as enquiries that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the browser’s address bar changes from “http://” to “https://” and by the padlock symbol in your browser bar. If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.
4. Data collection on this website
Cookies
Our web pages use so-called “cookies”. Cookies are small data packets and do not cause any damage to your terminal device. They are stored either temporarily for the duration of a session (session cookies) or permanently (permanent cookies) on your terminal device. Session cookies are automatically deleted at the end of your visit. Permanent cookies remain stored on your terminal device until you delete them yourself or until they are automatically deleted by your web browser.
Cookies may originate from us (first-party cookies) or from third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services of third-party companies within websites.
Cookies that are necessary to carry out the electronic communication process, to provide certain functions you have requested, or to optimise the website (necessary cookies) are stored on the basis of Art. 6(1)(f) GDPR, unless another legal basis is specified. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimised provision of its services. If consent to the storage of cookies and comparable recognition technologies has been requested, processing is carried out exclusively on the basis of this consent (Art. 6(1)(a) GDPR and Section 25(1) TDDDG); consent can be withdrawn at any time.
You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when the browser is closed. If cookies are deactivated, the functionality of this website may be limited.
Consent management
This website uses a self-operated consent technology to obtain your consent to the storage of certain cookies on your terminal device or to the use of certain technologies, and to document this in accordance with data protection law. No external consent service is integrated; processing takes place exclusively on our own domain.
When you enter the website, a cookie named wh_consent is stored in your browser for this purpose. It contains a randomly generated identifier for your consent, the time it was given, the consent version, the selected language and the categories you have released. The storage period is six months; after that we ask again. Neither your IP address nor any other directly identifying data is stored in this cookie.
Without your consent, services requiring consent are deactivated by default; corresponding scripts and embedded content are only loaded after you have released them. The consent technology is used to obtain the legally required consent for the use of cookies. The legal basis for this is Art. 6(1)(c) GDPR.
You can change or withdraw your consent at any time with effect for the future:
Server-side tagging (Google Tag Manager via our own domain)
To control the measurement and marketing technologies in use, we operate Google Tag Manager in a server-side configuration. The requests required for this run via our own domain and are processed by a server container operated on our behalf before being passed on – depending on your consent – to the respective service. As a result, less data is transmitted directly to third parties and you remain in control of which services receive data at all.
The Tag Manager itself does not set any cookies requiring consent. The consent status you have given (Google Consent Mode v2) applies to all services delivered through it: without consent, no cookies are set and no identifiers for recognition are processed. The legal basis for the use of the Tag Manager is our legitimate interest in a data-minimising and controlled delivery of services (Art. 6(1)(f) GDPR); for the services requiring consent delivered through it, the legal basis is your consent (Art. 6(1)(a) GDPR, Section 25(1) TDDDG).
Content delivery network and security (Cloudflare)
To deliver this website securely and quickly, we use services provided by Cloudflare Germany GmbH, Rosental 7, 80331 München, Germany (parent company: Cloudflare, Inc., 101 Townsend St., San Francisco, CA 94107, USA). Cloudflare provides a globally distributed content delivery network with security functions. Traffic to our website is routed via Cloudflare’s servers, in the course of which Cloudflare processes your IP address, among other things, in order to fend off attacks and deliver content.
For this purpose, Cloudflare sets technically necessary cookies (e.g. __cf_bm for bot detection, lifetime 30 minutes, and where applicable cf_clearance). The legal basis is Art. 6(1)(f) GDPR; we have a legitimate interest in the secure and performant operation of our website. A data processing agreement pursuant to Art. 28 GDPR is in place with Cloudflare; data transfer to the USA is based on the standard contractual clauses of the EU Commission. Further information: https://www.cloudflare.com/en-gb/privacypolicy/.
Server log files
The provider of these pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:
- browser type and browser version
- operating system used
- referrer URL
- host name of the accessing computer
- time of the server request
- IP address
This data is not merged with other data sources. This data is collected on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimisation of its website – for this purpose, the server log files must be collected.
Contact form
If you send us enquiries via the contact form, the details you provide in the enquiry form, including the contact data you provide there, will be stored by us for the purpose of processing the enquiry and in case of follow-up questions. We do not pass on this data without your consent.
This data is processed on the basis of Art. 6(1)(b) GDPR where your enquiry relates to the performance of a contract or is necessary to carry out pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective handling of the enquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) where this has been requested; consent can be withdrawn at any time.
The data you enter in the contact form remains with us until you ask us to delete it, withdraw your consent to its storage, or the purpose for storing the data no longer applies (e.g. after your enquiry has been fully processed). Mandatory statutory provisions – in particular retention periods – remain unaffected.
Enquiry by email, telephone or fax
If you contact us by email, telephone or fax, your enquiry, including all resulting personal data (name, enquiry), will be stored and processed by us for the purpose of handling your request.
The data you send us via contact enquiries remains with us until you ask us to delete it, withdraw your consent to its storage, or the purpose for storing the data no longer applies (e.g. after your request has been fully processed). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.
5. Analysis tools and advertising
Reach measurement via our own server (first-party)
To evaluate the use of this website, we use server-side reach measurement. The events collected in the process (e.g. page viewed, page language, click on a button) are first sent to an endpoint on our own domain and processed from there. In the default configuration, this measurement takes place without cookies and without recognising individual persons.
The legal basis is our legitimate interest in a statistical evaluation of website usage in order to improve our offering (Art. 6(1)(f) GDPR). Insofar as cookies are set or information is stored on or read from your terminal device as part of this measurement, this takes place exclusively on the basis of your consent (Art. 6(1)(a) GDPR, Section 25(1) TDDDG); consent can be withdrawn at any time.
Google Analytics
This website uses functions of the web analytics service Google Analytics. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.
Google Analytics enables the website operator to analyse the behaviour of website visitors. In doing so, the website operator receives various usage data, such as page views, dwell time, operating systems used and the origin of the user. This data is assigned to the respective terminal device of the user. It is not assigned to a user ID.
Google Analytics uses technologies that enable the recognition of the user for the purpose of analysing user behaviour (e.g. cookies or device fingerprinting). The information collected by Google about the use of this website is usually transferred to a Google server in the USA and stored there.
The use of this service is based on your consent in accordance with Art. 6(1)(a) GDPR and Section 25(1) TDDDG. Consent can be withdrawn at any time. Data transfer to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://privacy.google.com/businesses/controllerterms/mccs/.
IP anonymisation
We have activated the IP anonymisation function on this website. This means that your IP address will be shortened by Google within member states of the European Union or in other states party to the Agreement on the European Economic Area before being transmitted to the USA. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide further services to the website operator relating to website and internet usage. The IP address transmitted by your browser as part of Google Analytics will not be merged with other data from Google.
Browser plugin
You can prevent the collection and processing of your data by Google by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=en.
For more information on how Google Analytics handles user data, please see Google’s privacy policy: https://support.google.com/analytics/answer/6004245?hl=en.
Google Ads
The website operator uses Google Ads. Google Ads is an online advertising program of Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.
Google Ads enables us to display advertisements in the Google search engine or on third-party websites when the user enters certain search terms on Google (keyword targeting). Furthermore, targeted advertisements can be displayed on the basis of user data available at Google (e.g. location data and interests) (audience targeting). As the website operator, we can evaluate this data quantitatively, for example by analysing which search terms led to the display of our advertisements and how many advertisements resulted in corresponding clicks.
The use of this service is based on your consent in accordance with Art. 6(1)(a) GDPR and Section 25(1) TDDDG. Consent can be withdrawn at any time. Data transfer to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://policies.google.com/privacy/frameworks and https://privacy.google.com/businesses/controllerterms/mccs/.
6. Plugins and tools
Google Fonts (locally hosted)
This site uses web fonts for the uniform display of typefaces. The fonts used are installed locally on our own server and delivered from there. No connection to Google servers takes place in this process.
Google Maps
Where the map service Google Maps is embedded on individual pages, the provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.
In order to use the functions of Google Maps, it is necessary to store your IP address. This information is usually transferred to a Google server in the USA and stored there. The provider of this site has no influence on this data transmission. The map is only loaded after your explicit consent.
Google Maps is used in the interest of an appealing presentation of our online offering and easy discoverability of the places indicated by us on the website. This constitutes a legitimate interest within the meaning of Art. 6(1)(f) GDPR. Insofar as corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and Section 25(1) TDDDG. Consent can be withdrawn at any time.
Data transfer to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://privacy.google.com/businesses/gdprcontrollerterms/ and https://privacy.google.com/businesses/gdprcontrollerterms/sccs/. More information on the handling of user data can be found in Google’s privacy policy: https://policies.google.com/privacy?hl=en.
7. Own services
Enquiry handling and customer management (CRM)
Enquiries that you send us via the forms on this website are received by an automation service operated by ourselves (n8n) and stored in our likewise self-operated customer management system (Twenty CRM). Both systems run on servers in Germany that are operated exclusively by us; no transfer to an external CRM provider takes place.
The data you provide (e.g. name, company, email address, telephone number, website address, message) is processed, along with technical metadata of the transmission (time, page visited, language) and the status of your cookie consent. The latter is stored so that we can demonstrate on what basis a subsequent contact is permissible.
Processing is based on Art. 6(1)(b) GDPR where your enquiry relates to the initiation or performance of a contract, and otherwise on our legitimate interest in the efficient handling of enquiries (Art. 6(1)(f) GDPR). Your data remains with us until the purpose no longer applies or you ask us to delete it; statutory retention periods remain unaffected.
Handling of applicant data
We offer you the opportunity to apply to us (e.g. by email, by post or via an online application form). In the following, we inform you about the scope, purpose and use of your personal data collected during the application process. We assure you that the collection, processing and use of your data will be carried out in accordance with applicable data protection law and all other statutory provisions, and that your data will be treated in strict confidence.
Scope and purpose of data collection
When you send us an application, we process your associated personal data (e.g. contact and communication data, application documents, notes taken during interviews, etc.) to the extent necessary to decide on the establishment of an employment relationship. The legal basis for this is Section 26 BDSG under German law (initiation of an employment relationship), Art. 6(1)(b) GDPR (general contract initiation) and – if you have given your consent – Art. 6(1)(a) GDPR. Consent can be withdrawn at any time. Your personal data will only be passed on within our company to persons involved in processing your application.
If the application is successful, the data submitted by you will be stored in our data processing systems on the basis of Section 26 BDSG and Art. 6(1)(b) GDPR for the purpose of implementing the employment relationship.
Retention period of the data
If we are unable to make you a job offer, if you reject a job offer or withdraw your application, we reserve the right to retain the data you have submitted on the basis of our legitimate interests (Art. 6(1)(f) GDPR) for up to six months from the end of the application process (rejection or withdrawal of the application). The data will then be deleted and the physical application documents destroyed. This storage serves in particular as evidence in the event of a legal dispute. If it is apparent that the data will be required after the six-month period has expired (e.g. due to an impending or pending legal dispute), the data will not be deleted until the purpose for continued storage no longer applies.
Longer storage may also take place if you have given corresponding consent (Art. 6(1)(a) GDPR) or if statutory retention obligations prevent deletion.
Inclusion in the applicant pool
If we do not make you a job offer, it may be possible to include you in our applicant pool. In the event of inclusion, all documents and details from the application will be transferred to the applicant pool in order to contact you in the event of suitable vacancies.
Inclusion in the applicant pool is based exclusively on your express consent (Art. 6(1)(a) GDPR). Giving consent is voluntary and is not related to the current application process. The data subject may withdraw their consent at any time. In this case, the data will be irrevocably deleted from the applicant pool, unless there are statutory reasons for retention. The data from the applicant pool will be irrevocably deleted no later than two years after consent has been given.
8. Validity of this privacy policy
This privacy policy is currently valid. As our website develops or due to changed legal or regulatory requirements, it may become necessary to amend this privacy policy.
